Participation in the game

To register at www.merkurxtip.rs you must meet the following conditions:

MerkurXtip has the discretion to approve or reject the application for registration on the official website www.merkurxtip.rs or use the Merkurxtip service to any User or potential User at any time. Registration on the official site www.merkurxtip.rs is private and cannot be passed on to any other person.

The data submitted during the basic registration must be complete and accurate, and among other things must contain the following: Name, Surname, E-mail address, Unique Citizen’s Number (JMBG), Date of birth, Password, password confirmation.

If there is a change in the data in relation to the data submitted during registration, the registered User shall notify the Organizer without delay.

Users shall keep confidential the personal password they need to use the MerkurXtip service, which they chose during registration.

Special promotions are valid only for players who have received a promotional email/offer from MerkurXtip. Bonus offers are limited to one person, one household member, email address, IP address. By participating in one promotion, the right to participate in another promotion organized by MerkurXtip is revoked.

The Organizer reserves the right to at any time, without explanation, completely or partially refuse any participation in games of chance, as well as to close the user account without explanation.

The use of any mechanism, software or other products that may interfere with the normal operation of the official site www.merkurxtip.rs and MerkurXtip internet service is prohibited.

Privacy protection

MerkurXtip fully undertakes to respect and protect the privacy of registered users. The data submitted for registration by the user is kept confidential for our purposes for the use of the MerkurXtip service and serves only the purpose for which it has been provided. The data may be given to third parties only if ordered to do so by a state authority, for the purposes of court proceedings and in other cases, in full compliance with the law or other regulations.

Email addresses can only be used to provide our registered users with information about the services provided by MerkurXtip.

The Organizer undertakes to collect, process and store personal data about participants and their user accounts exclusively for the purpose of user participation in games of chance through the means of electronic communication organized by the Organizer. The Organizer will keep this data as a business secret, and treat it in accordance with applicable legislation, especially in accordance with the Law on Personal Data Protection (Official Gazette of RS 97/08, 104/2009-other law, 68/2012 – CC Decision and 107/2012), and these Rules.

The Organizer shall take permanent measures to protect personal data from their misuse, destruction, loss, unauthorized change or access. At the request of the Organizer for the purpose of verifying identity or coming of age, the Player is obliged to present a personal identification document.

Exclusion of responsibility

MerkurXtip shall not responsible for the temporary unavailability of its website, nor for its partial or complete non-functioning, for the malfunction of the official website, nor for technical problems that may arise during the operation of the official website and MerkurXtip web service.

Terms of payment through payment cards

General provisions

The General Terms and Conditions of Payment to the User Account of Gambling Participants through Payment Cards via the Internet (hereinafter: General Terms and Conditions) determine the conditions under which a stakeholder (hereinafter: the Participant) may make a payment to his/her user account through the Internet (hereinafter: the user account) opened on the MerkurXtip website, through payment cards. MerkurXtip reserves the right to change these General Terms and Conditions in accordance with its business policy or change the offer and/or positive legal regulations, of which it informs the Participant on its website in a timely and usual manner.

Payment amount

The amount of the payment to the user account is expressed in dinars.

Method of payment

The participant makes a payment to the user account through payment cards. Payment is possible with cards: VISA, MasterCard, Maestro.

Complaints

The participant can report all complaints about the payment to the account through Live Chat or by sending an e-mail to [email protected] (hereinafter: Customer Service). If the Participant has made a payment to the user account and received a confirmation message by e-mail, and the amount in the user account has not increased, it is necessary to contact the Customer Service by e-mail with the transaction ID to manually increase the amount on the user account. If the Participant has made a successful payment to his/her account and received a confirmation message or e-mail about the payment and the amount in his/her account has increased, MerkurXtip cannot refund the paid funds. If the Internet connection is interrupted during the payment, and the Participant has received a confirmation e-mail about the successful payment and does not know whether the amount in his/her account has been increased, it is necessary to contact the Customer Service. In case of unsuccessful payment or for any other reason based on the law or the rules of the game and refund to the Participant who previously made payment through one of the payment cards, in part or in full, regardless of the reason for return, MerkurXtip shall refund only through VISA, EC/MC and Maestro payment methods, which means that the bank will refund the funds to the cardholder’s account at the request of MerkurXtip.

Payments not accepted

If there is a problem with the payment of funds to the account, please contact your bank, which owns the card. The bank may refuse a transaction for any of the following reasons:

Limitation of liability

MerkurXtip completely disclaims any liability for damage that may occur to the Participant and/or third parties due to unauthorized use of the payment card or any misuse of the latter (stolen payment card, use of the payment card without the owner’s knowledge, etc.) and in this case MerkurXtip shall not refund the funds paid. MerkurXtip shall not be responsible for the interruption of the internet connection or the unavailability of the payment card processor.

Protection of confidential transaction data

When entering payment card data, confidential information is transmitted through a public network in a protected (encrypted) form using SSL protocols and PKI systems, as currently the most modern cryptographic technology. Data security during payment is guaranteed by the payment card processor, Payten d.o.o. Belgrade, so the complete billing process is performed on the bank’s website. At no time is payment card information available to the MerkurXtip system. On behalf of MerkurXtip, we undertake to protect the privacy of all our Participants in the games of chance (Customers/Users). We collect only the necessary, basic data on customers/users and data necessary for business and informing users in accordance with good business practices and in order to provide quality service. We give customers a choice including the ability to decide whether or not they want to be deleted from the mailing list of the marketing campaign. All data on the users/customers are kept confidential and are accessible only to the employees who need the data for performing business activities. All employees of MerkurXtip (and business partners) are responsible for observing the principle of privacy protection. The safety of data when buying is quaranteed by the processor of payment cards. For VISA, MasterCard and Maestro, the processor is Payton d.o.o. Belgrade, so the complete payment process is performed on the bank’s website. At no time are the data in the payment card available to the MerkurXtip Company system, so MerkurXtip shall not be held liable for their misuse.

By completing the transaction, it is considered that the user is familiar with the General Payment Services, that he/she accepts them and that he/she fully agrees with them.

Application of the Rules in organizing special games of chance through electronic communications

For all issues not regulated by these General Terms and Conditions of Payment, the Rules on organizing special games of chance through electronic means of communication published on the MerkurXtip website shall apply in a subsidiary manner.

Account suspension

If the registered user violates the Rules on organizing games of chance through electronic means of communication or the Terms and Conditions of Use, MerkurXtip will close the user account, for a certain period of time or permanently, and the user will be notified by sending an e-mail to the provided e-mail address.

Bonuses, Promotions, Offers

Only one bonus per person, household, address, IP address and device is allowed. The Organizer reserves the right to change the conditions, cancel or in any other way change the promotion. If players take measures, strategies, or in any other way, in the opinion of MerkurXtip, abuse the system and the promotion, we reserve the right to declare the promotion invalid in relation to the player who commits malicious behavior.

Special promotions

Special promotions are valid only for the players who have received a promotional email/offer from MerkurXtip.

Other rules, Jurisdiction

These are the Terms and Conditions of Use of the MerkurXtip service, and special rules and conditions define the rules and conditions for the use of each specific service.

The court in Novi Sad has real and local jurisdiction over all disputes between MerkurXtip and registered users. MerkurXtip reserves the right to discreetly change the General and Special Terms and Conditions of Use of the MerkurXtip service with the obligation to inform its registered users on its official website.

These Terms and Conditions of Use and the Rules on Organizing Games of Chance through Electronic Means of Communication are published on the official website www.merkurxtip.rs, and apply from the date of publication.

These rules shall come into force after obtaining the consent of the Minister of Finance and apply from the date of publication on the website of the Organizer.
